SALES TERMS AND CONDITIONS
The online store PROFACTOR.EU (hereinafter the “Online Store”) is owned by OÜ PROFACTOR-BALTIC (registry code 14084070), located at Tartu mnt 83-205, Kesklinna district, Harju County, Tallinn, Estonia, 10115.
Validity of the sales contract; product and price information
These Sales Terms and Conditions apply to purchases of goods from the Online Store.
The prices of products sold in the Online Store are displayed next to the products. A delivery fee is added to the price. All prices of goods sold in the Online Store are stated in euros.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when the order is placed.
Product information is provided in the Online Store directly alongside each product.
Placing an order
To order goods, add the desired products to the shopping cart. To place an order, complete the required fields and select a suitable delivery method. The amount payable will then be displayed on the screen and can be paid securely using the following payment methods:
- Bank payments
- Card payments
- Apple Pay, Google Pay, Shopify Payments, BLIK, Klarna, MobilePay
Important: When paying via a bank link, be sure to click the “Return to merchant” button on the bank’s website.
Payments are processed by Montonio Finance OÜ, Maksekeskus AS and Shopify Payments. Payment is made outside the Online Store in a secure environment: in the secure environment of the relevant bank when paying via a bank link, or in the secure environment of the payment service provider when paying by credit card. The seller does not have access to the customer’s bank or credit card details. The contract enters into force when the amount payable is credited to the Online Store’s bank account.
The owner of the Online Store is the controller of personal data and transfers the personal data necessary for processing payments to an authorised processor, namely the payment service provider.
If the ordered goods cannot be supplied because they are out of stock or for any other reason, the buyer will be notified as soon as possible and the amount paid (including delivery costs) will be refunded without delay, but no later than 14 days after the notification is sent.
Delivery
Goods are shipped to EU countries.
The buyer may choose from the following delivery methods: SmartPosti, Omniva, Unisend, DPD, Montonio International Shipping and others.
The buyer bears the shipping costs, and the relevant price information is displayed alongside the delivery method.
Shipments within Estonia generally arrive at the destination specified by the buyer within 1–3 business days after the sales contract enters into force. Deliveries outside Estonia take 2–5 business days.
In exceptional cases, the Online Store has the right to deliver the goods within up to 45 calendar days.
Right to lodge a complaint
The Online Store is liable for any non-conformity or defect in the goods sold to the buyer that existed at the time the goods were handed over and becomes apparent within two years after the goods were handed over to the buyer. If the defect becomes apparent within one year after the goods were handed over to the buyer, it is presumed to have existed at the time of delivery. The Online Store bears the burden of rebutting this presumption.
If a defect becomes apparent, the buyer has the right to contact the Online Store within two weeks at the latest by emailing shop@profactor.eu.
The Online Store is not liable for defects that arise after the goods have been handed over to the buyer.
If goods purchased from the Online Store have defects for which the Online Store is liable, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all amounts paid under the sales contract.
The Online Store will respond to a complaint submitted by a consumer in writing or in a format that can be reproduced in writing within 15 days.
Direct marketing and processing of personal data
The Online Store uses the personal data entered by the buyer solely to process the order and deliver the goods to the buyer. The Online Store transfers personal data to transport service providers for the purpose of delivering the goods.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has opted to receive them by entering their email address on the website and indicating that they wish to receive direct marketing communications.
The buyer may unsubscribe from offers and newsletters sent by email at any time by notifying us by email or by following the instructions in the email containing the offer.
Dispute resolution
Any complaints concerning the Online Store must be sent by email to shop@profactor.eu.
If an individual buyer and the Online Store are unable to resolve a dispute by agreement, the buyer may refer the matter to the Consumer Disputes Committee. The rules of procedure and the application form are available here. The Consumer Disputes Committee is competent to resolve disputes arising from a contract concluded between the buyer and the Online Store. The Committee reviews the buyer’s complaint free of charge. The buyer may also use the European Union’s Online Dispute Resolution platform.
These Sales Terms and Conditions and the contract concluded between the buyer and the Online Store are governed by Estonian law. Unless otherwise provided by law, all disputes arising from these Sales Terms and Conditions or the contract will be resolved by Harju County Court.
